If the delay has being made more than 45 days from the signing of the Sales Contract hereof, the buyer shall pay 3% of total amount each day, and if the delay is more than 6 months, the Seller has the right to dispose the down payment and the goods. If the late delivery is caused by the Seller, the Seller shall inform the Buyer in advance and get confirmation from the Buyer, and the related expense shall be born by the Seller.

　　(16) 質(zhì)量/數(shù)量異議：對(duì)于質(zhì)量方面的異議，買方必須在貨物抵達(dá)目的港后30天之類提出：對(duì)于數(shù)量方面的異議，買方必須在貨物抵達(dá)目的港后15天之內(nèi)提出。對(duì)由于保險(xiǎn)公司、運(yùn)輸公司、其他運(yùn)輸機(jī)構(gòu)或郵局的原因所造成的貨物差異，賣方不負(fù)任何責(zé)任。 QUALITY/QUANTITY DISCREPANCY: In case of quality discrepancy, claim shall be filed by the Buyer within 30 days after the arrival of the goods at port of destination; while for quantity discrepancy, claim shall be filed by the buyer within 15 days after the arrival of the goods at port of destination. It is understood that the Seller shall not be liable, for any discrepancy of goods shipped due to causes for which the Insurance Company, Shipping Company, other transportation organization or Post Office are liable.

　　(17) 不可抗力：賣方對(duì)由于下列原因而導(dǎo)致不能或暫時(shí)不能履行全部或部分合同義務(wù)的，不負(fù)責(zé)任：水災(zāi)、火災(zāi)、地震、干旱、戰(zhàn)爭(zhēng)或其他任何在簽約時(shí)賣方不能預(yù)料、無(wú)法控制且不能避免和克服的事件。但賣方因盡快地將所發(fā)生的事件通知對(duì)方，并應(yīng)在事件發(fā)生后15天內(nèi)將有關(guān)機(jī)構(gòu)出具的不可抗力事件的證明寄交對(duì)方。如果不可抗力事件之影響超過(guò)120天，雙方應(yīng)協(xié)商合同繼續(xù)履行或終止履行的'事宜。

　　FORCE MAJEURE: Seller shall not be responsible for failure or delay in performance of entire or portion of these Sale Contract obligations in consequence of Force Majeure incidents: flood, fire, earthquake, drought, war, or any other matters couldn’t be foreseen or controlled or couldn’t be avoided. But Seller shall inform the incidents to Buyer immediately, and shall delivery the certificate of Force Majeure incidents issued by related organization within 15 days after the incidents happened. If the incidents influence more than 120 days, both parties shall negotiate to decide whether to execute or terminate the Sales Contract.

　　(18) 仲裁：因履行本合同所發(fā)生的一切爭(zhēng)議，雙方應(yīng)友好協(xié)商解決，如協(xié)商仍不能解決爭(zhēng)議，則應(yīng)將爭(zhēng)議提交中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)（北京），依據(jù)其仲裁規(guī)則仲裁。仲裁裁決是終局的，對(duì)雙方都有約束力。仲裁費(fèi)應(yīng)由敗訴一方承擔(dān)，但仲裁委員會(huì)另有裁定的除外。在仲裁期間，除仲裁部分之外的其他合同條款應(yīng)繼續(xù)執(zhí)行。

　　ARBITRATION: All disputes across from the execution of, or in connection with this Sales Contract shall be settled friendly through negotiation, in case no settlement can be reached, the case shall then be submitted to China International Economic and

　　Trade Arbitration Commission, Beijing for arbitration in accordance with its provisional rules of procedure. The result of arbitration shall be born by the losing party except for the condition the Commission has other judgment. 　　Mrs. Ghazala Waheed wo Abdul Waheed, Adult, Ro House No.***-*, DHA, Lahore Cantt, (hereinafter to as the LESSOR of the ONE PART).

　　Mr.* ***,Ro China, refereed to as the LESSEE of the OTHER PART.(Expression “LESSOR”

　　and “LESSEE” wherever the context so permit shall always mean and include their reective heirs, successors legal representative and assignees).

　　WHEREAS the LESSOR is the lawful owner and in lawful possession of House No,***-*,DHA,

　　Lahore Cantt, consisting of 4 Bedrooms with bath, DD,TV; Lounge, Kitchen, Store, Servant, Quarter together with fixtures and fitting (hereinafter collectively called the DEMISED PREMISES).

　　AND WHEREAS the LESSOR has agreed the lease and the LESSEE has agreed to take on lease the DEMISED PREMISES on the terms and condition as given below:-

　　8.2 租賃期內(nèi)甲方不得收回出租房屋(除非本合同另有規(guī)定)，甲方保證乙方可不受干擾的享用該物業(yè)。

　　party a shall not repossess the leased property during the term of party a disturb of interfere with party b’s quiet enjoyment of the leased property.

　　8.3 在乙方遵守本合同的條款及支付租金的前提下，乙方有權(quán)于租賃期內(nèi)拒絕甲方或其他人騷擾而安靜享用出租房屋。

　　8.4 租賃期內(nèi)出租房屋的結(jié)構(gòu)，進(jìn)出物業(yè)的排水、上下管道、電路等處于良好使用狀態(tài)。

　　九、乙方的責(zé)任：

　　9.2 乙方應(yīng)愛(ài)護(hù)使用出租房屋，如因乙方的.過(guò)失或過(guò)錯(cuò)致使房屋設(shè)施及屋內(nèi)用具和飾品受到損壞(正常損耗除外)，乙方應(yīng)負(fù)賠償責(zé)任。

　　9.3 乙方應(yīng)按本合同的約定合法使用出租房屋，不得擅自改變使用性質(zhì)，不應(yīng)存放中華人民共和國(guó)法律下所禁止的危險(xiǎn)物品，如因此發(fā)生損害，乙方應(yīng)承擔(dān)全部責(zé)任。

　　party b shall use the leased property legally as agreed in this agreement and may not change such use on its own…party b shall not store any dangerous items which are prohibited by the laws in the people’s republic of china in the leased property and shall be fully reonsible for any admages of losses as result thereof.

　　9.4 未經(jīng)甲方事先書面同意，乙方不得將出租房屋轉(zhuǎn)租或租給其他的第三者。

　　十、違約處理：

　　十一、適用法律：

　　3.6若病假連續(xù)超過(guò)三天，公司支付三天基本工資的一半。超過(guò)三天的部分則按現(xiàn)行照法定病金支付。若病假持續(xù)，符合社會(huì)保障部法定病金的相關(guān)規(guī)定，則從病假的第一天起，公司只支付法定病金，所有的病假都應(yīng)有醫(yī)學(xué)證明。

　　Party B sick leave exceeds three days in one continuous period the Employer will pay at half your basic rate the first three days. Thereafter pay will be at the current rate of Statutory Sick Pay. 　　四、雇傭合同的解除和終止

　　ⅣContract Cancellation and Termination

　　4.1 合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時(shí)，雇傭合同即終止。

　　This contract shall be terminated once it expires and both parties do not extend the contract.

　　4.2 經(jīng)合同雙方當(dāng)事人協(xié)商一致，本合同可以解除。

　　4.3 乙方應(yīng)遵守中國(guó)的法律、法規(guī)及有關(guān)規(guī)定，乙方如違反上述規(guī)定，甲方有權(quán)即時(shí)解除合同；乙方因健康原因，經(jīng)醫(yī)生證明連續(xù)病休15工作日后仍不能繼續(xù)工作，甲方有權(quán)提前終止合同。
